張震遠承認的兩項違反《僱傭條例》罪名,包括未有履行勞資審裁處的判令,就此罪判監8周,獲減刑至6周。勞工處指自2010年10月起將拖欠勞資審裁處判令款項列為刑事罪行後,張震遠為首宗以公司負責人的身份而被判處即時監禁的個案。
勞工處資料顯示,在2010至去年間,共有859張與張震遠相同控罪、即僱主未有支付工資的傳票被定罪,當中有5名僱主被判即時監禁2至3個月,另有32名僱主或公司負責人被判緩刑或社會服務令。

官指案情嚴重不適合緩刑

至於張的另一控罪、即未有履行勞資審裁處判令,處方指相同時段,共有326張傳票被定罪,其中129張涉及公司負責人。當中有1名僱主被判處即時監禁3個月,另有9名僱主或公司負責人被判緩刑或社會服務令。處方強調將繼續嚴厲執法,把違例僱主或公司負責人繩之於法,以保障僱員權益。
裁判官香淑嫻昨判刑時稱,過往雖有違反《僱傭條例》判罰緩刑的案例,但她認為本案嚴重,考慮涉案的金額及拖欠時間後,認為不適合緩刑。
